Terms of Service

The rules for using crash.party. We tried to keep them readable.

1. Acceptance

These Terms of Service ("Terms") are a contract between you and [[Company Legal Name]] ("crash.party", "we", "us") covering your use of crash.party and any related services (the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

2. Who can use crash.party

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. Some jurisdictions set a higher minimum age for digital consent — if you live somewhere with a higher minimum, that age applies.

You may not use the Service if you have previously been banned, or if doing so would be illegal where you live.

3. Your account

You can play as a guest without an account. If you create an account, you are responsible for keeping your credentials secure and for everything that happens under your account. Notify us promptly if you suspect unauthorized access.

One person, one account. Don't sell, transfer, or share your account.

4. License to use the Service

Subject to these Terms, we grant you a personal, non-transferable, non-exclusive, revocable license to access and use crash.party for your own non-commercial entertainment.

This license does not let you copy, modify, distribute, sell, sublicense, reverse engineer, decompile, or extract source from the Service, except where applicable law expressly permits.

5. Acceptable use

Don't do any of this:

  • Cheat, exploit bugs for unfair advantage, use bots, macros, or automated clients.
  • Reverse engineer, scrape, or run unauthorized clients or servers.
  • Harass, threaten, dox, or send hate speech to other players — in chat, voice, display names, or anywhere else.
  • Impersonate another person or claim affiliations you don't have.
  • Upload or transmit malware, spam, or illegal content.
  • Interfere with the Service or with other players' enjoyment of it.
  • Use the Service to violate any law or third-party rights.

We can suspend or terminate accounts for any of the above, with or without notice. Repeat offenses, severe abuse, or anything illegal gets a permanent ban.

6. Voice chat and in-game communication

Voice chat is on by default during sessions. By joining a session, you consent to your voice being transmitted in real time to the other players (and any spectators) in your lobby. We do not currently record or store voice chat — see the Privacy Policy for details.

You are responsible for what you say. Voice, chat, display names, emoji, character customizations, and any other in-game communications are subject to the acceptable use rules above.

7. Your content

You keep ownership of the names, messages, and customizations you create. By submitting them, you grant us a worldwide, royalty-free, non-exclusive license to host, transmit, display, and process them solely as needed to operate the Service and moderate abuse.

We may review, remove, or refuse to display any user content that violates these Terms.

8. Virtual items and purchases

The Service may include virtual items — characters, costumes, emotes, currencies, and similar — that you can earn through play or purchase with real money.

Virtual items are licensed to you, not sold. They have no real-world monetary value, cannot be redeemed for cash, and cannot be transferred outside the Service. We may modify, suspend, or remove virtual items at any time, including for balance, legal, or operational reasons. Earned items are retained while your account remains in good standing.

Refunds for purchased items are handled in accordance with the payment processor's policy and applicable law. Once a virtual item has been used or consumed, it is generally non-refundable.

9. Our intellectual property

crash.party, the crash.party logo, the game code, art, music, characters, sound effects, dialogue, and all related materials are owned by us or our licensors. Nothing in these Terms transfers any of that to you.

10. Beta

The Service is currently in beta. It may change, break, or be temporarily unavailable. Features may be added, modified, or removed without notice. We may share your account and a description of issues with the team working on the bug.

11. Termination

You can stop using the Service at any time. You can delete your account by emailing support@crash.party.

We can suspend or terminate your account at any time if you violate these Terms or if we reasonably believe continued access creates risk for us or other users. We can also discontinue the Service or any part of it. Where reasonable, we will give notice.

Sections that by their nature should survive termination (including sections 7, 9, 12, 13, 14, and 15) will survive.

12. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation, to the maximum extent permitted by law.

13. Limitation of liability

To the maximum extent permitted by law, neither crash.party nor its directors, employees, or agents will be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service.

Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) US $100.

Some jurisdictions don't allow some of these exclusions, in which case they apply to you only to the extent permitted.

14. Indemnification

You agree to indemnify and hold harmless crash.party from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your violation of these Terms, your misuse of the Service, or your violation of any law or third-party right.

15. Governing law and disputes

These Terms are governed by the laws of [[State/Country of incorporation]], without regard to its conflict of laws principles. Any dispute will be resolved exclusively in the courts of [[Venue]], except where binding arbitration or a different venue is required by applicable consumer protection law.

You and crash.party agree that any dispute will be resolved on an individual basis only and not as a class action.

16. Changes to these Terms

We may update these Terms as the Service evolves. We will update the "Last updated" date and, for material changes, give notice through the Service or by email. Continued use after a change means you accept the updated Terms.
